Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and 1953 ("we," "us," or "our") governing your access to and use of the 1953 mobile application ("the App").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

Eligibility

To use the App, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

By using the App, you represent and warrant that you meet all eligibility requirements.

Description of Service

1953 is a car rental management application that allows users to:

• Browse available vehicles and view detailed information
• Book and manage car rentals
• Access rental information offline
• Extend or cancel existing bookings
• Access unique QR codes for vehicle pickup
• Calculate pricing for rental periods

The App serves as a platform for managing car rental activities and may connect you with third-party rental providers.

User Account

Certain features of the App may require you to create an account or provide personal information. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your account credentials confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Transmit viruses, malware, or other harmful code
• Use automated systems to access the App without permission
• Collect or harvest user information without consent
• Impersonate any person or entity
• Engage in any fraudulent or deceptive activities
• Use the App for any illegal or unauthorized purpose

Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and design) are owned by 1953 or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Transfer your rights to use the App to another person
• Use the App to create derivative works

Third-Party Services

The App may contain links to third-party websites, services, or content that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.

Your use of third-party services is at your own risk and subject to the terms and conditions of those third parties.

Booking and Rental Terms

When using the App to book vehicle rentals:

• All bookings are subject to vehicle availability
• Prices displayed are estimates and may be subject to change
• Final rental terms are established with the rental provider
• Cancellation policies may vary by rental provider
• You are responsible for meeting all rental requirements
• Additional fees may apply (insurance, fuel, damage, etc.)

We act as an intermediary and are not directly responsible for the actual rental services provided by third-party rental companies.

Payment Terms

If the App facilitates payments:

• You agree to pay all applicable fees and charges
• Prices are displayed in the currency specified at checkout
• You authorize us to charge your selected payment method
• Refunds are subject to the applicable cancellation policy
• You are responsible for any applicable taxes

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1953 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability exceed the amount you paid us, if any, for accessing the App during the twelve (12) months prior to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless 1953 and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Modifications to Terms

We may revise these Terms from time to time at our sole discretion. All changes are effective immediately when posted. Your continued use of the App following the posting of revised Terms means you accept and agree to the changes.

We encourage you to review these Terms periodically for any updates.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will immediately cease
• Any provisions that should survive termination shall survive
• We may delete your account and associated data

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 1953 is established, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration association.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

No waiver by us of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the App, constitute the entire agreement between you and 1953 concerning your use of the App.
